These Terms of Service ("Terms") govern your use of the Tradie Leads Co website (tradieleadsco.au) and the marketing services we provide. Tradie Leads Co (ABN 74 125 065 485) is referred to as "we", "us", or "our". By using our website or engaging our services, you agree to these Terms.

1. Our services

We provide digital marketing services for local businesses, which may include website design and hosting, search engine optimisation (SEO), Google Ads and other paid advertising management, Google Business Profile setup and management, CRM setup, AI search optimisation (AEO/GEO), and related services. The specific services, deliverables and fees for any engagement will be set out in a separate proposal, quote, or plan agreed between us.

2. No guarantee of results

Digital marketing results depend on many factors outside our control, including search engine and advertising platform algorithms, competition, your budget, your market, and your own responsiveness to leads. While we work to deliver strong outcomes and draw on a proven track record, we do not guarantee specific rankings, traffic volumes, lead numbers, sales, or return on investment. Any examples of past results are illustrative and not a promise of future performance.

3. Fees and payment

Fees for ongoing plans are billed monthly in advance unless otherwise agreed. Where we manage advertising campaigns, you pay your advertising spend directly to the relevant platform (such as Google or Meta) — advertising spend is separate from our management fees and is your responsibility. Fees are in Australian dollars and, unless stated otherwise, are inclusive of any applicable GST. Late or failed payments may result in services being paused.

4. Your responsibilities

You agree to provide accurate information, timely access to the accounts and assets we need (such as your website, domain, Google and social accounts), and any content or approvals required to deliver the services. You are responsible for the accuracy and legality of any materials you provide, and for owning or having the rights to use them.

5. Third-party platforms

Our services rely on third-party platforms including Google, Meta, and HighLevel. Your use of those platforms is subject to their own terms and policies. We are not responsible for changes, outages, price increases, account suspensions, or actions taken by those platforms, and such events are outside our control.

6. Intellectual property

Content, materials and strategies we create for you become yours once all related fees are paid, except for any tools, templates, systems, or know-how we use across our business, which remain our property. Any content, logos, or materials you provide remain yours, and you grant us the right to use them to deliver the services. Our website and its contents remain our intellectual property.

7. Cancellation

Ongoing plans are month-to-month with no lock-in contract unless otherwise agreed in writing. Either party may cancel by giving [14] days' written notice before the next billing date. Fees already paid for the current billing period are non-refundable. On cancellation, we will provide reasonable assistance to hand over your accounts and assets.

8. Confidentiality

Each party agrees to keep the other's confidential information private and to use it only for the purpose of the engagement.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the services is limited to the amount of fees you paid us in the three months before the claim arose. We are not liable for any indirect, incidental, or consequential loss, including loss of profits, revenue, or business. Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Indemnity

You agree to indemnify us against any claims, losses, or costs arising from your breach of these Terms, your misuse of the services, or the content and materials you provide to us.

11. Governing law

These Terms are governed by the laws of the Australian Capital Territory, Australia, and you submit to the non-exclusive jurisdiction of the courts of that territory.

12. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available on this page with an updated effective date. Continued use of our website or services means you accept the updated Terms.
